I don't think both people become the faction member; Right now I am tied with Arabesque (hope I spelled that right) for LCN, and she is the only one listed in the faction.

In the case of a tie:
1) If one of the two people was the previous day's faction leader, than that person remains the leader (you have to beat the existing leader to become the new leader).
2) If neither of the two tied detectives was the previous leader, the game picks one of the tied detectives randomly.

That is the funny thing. I was the faction leader on Sat (day the server went down) ; When server came up on Monday, I had been booted off; I was only a leader for half a day.

Actually there was a server reset on Monday after things were restored. Those who logged in right away and did their cases had them replenished, etc.
Just another quirk in the Sleuth Space Continiuum.
