I wouldn't really call it evil either.
First off I think it's a lovely gesture and a great service that Ben already provides us with the option to send in a different picture for our detective if we want - doubt there are a lot of games where you even have that opportunity.
Second if he were to make it free so that we could just upload our own, he wouldn't be able to ensure that those that were chosen would fit the format and style of the game. What I mean is there wouldn't be anything stopping people from choosing cartoon figures, flowers, or animals as their avatars (pictures which would also show up as suspects in a case - *imagines trying to sweet talk Goofy*), not to mention colour photos (although maybe it would be possible to install some parameters that would make the pictures always show up in black and white?) which would destroy the carefully designed look of the game.
So all in all I'd say it's pretty good the way it is :)
