Do you have to be subscribed to become one?

No you don't have to be. But it is really hard. To become consigliere you need to be the best of the faction. The way to get that is play the little jobs succesfully, and quit the games that are bad for the faction.

Considering that subbed members get 10 cases a day, they do get more cases that are good for their faction.

Also subbed agents in agency can swap cases with team mates, so they have even more chance of getting faction cases.
