judging character??

I've been playing for a while with some other detectives, Sam the Rose and Balash. They're tough types. With Roberta here, I went for both charm and tough and I have judging character. My arch type is tough and smart and I'm dressed for +6 tough, and plus +2 charm. I feel like I have my bases covered somewhat.
When I use the judging character and it tells me to use Toughness to convince my suspect/townie, 99% of the time, they clam! But if I use charm, even if it's not recommended, they talk...!

Is this a bug?
Am I doing something wrong?

I can't seem to solve a case above the hard level.

I also use both and judge skill. What you need to look at are the numbers not the conclusion. Then you know if you need to go change (assuming you are in an agency). Your skills also up the numbers, so you have the basic number plus your outfit plus the skill.
